Penalties your employer may owe
If your employer intentionally failed to pay, it owes the unpaid wages plus liquidated damages, court costs and attorney's fees (Iowa Code § 91A.8). Liquidated damages are 5% of the unpaid wages for each day unpaid (not counting Sundays, holidays and the first 7 days after payday), up to the amount of the unpaid wages (§ 91A.2(6)). If a late paycheck causes an overdraft on your account, the employer owes the overdraft charge (§ 91A.3(3)(b)).
Retaliation and immigration status
Your employer may not fire you or discriminate against you because you filed a wage complaint, assigned a claim to DIAL, sued, or helped with a case. You can complain to DIAL within 30 days; DIAL can go to court to get your job back with back pay (Iowa Code § 91A.10(5)).
Federal law also makes it illegal to fire or punish you for filing a wage complaint or cooperating in an investigation (US DOL Fact Sheet #77A).
The US Department of Labor’s Wage and Hour Division enforces federal wage law without regard to immigration status, and its services are free and confidential whether you are documented or not (US DOL).
Deductions and tips
Your employer may deduct only what the law requires or what you authorize in writing for your benefit. It may not deduct shared-till shortages, breakage or damage you did not cause on purpose, bounced checks, most lost or stolen property, your tips, or most protective equipment (Iowa Code § 91A.5). If you get more than $30 a month in tips, your employer may pay as little as $4.35 an hour, but wage plus tips must average at least $7.25 (Iowa Code § 91D.1; DIAL FAQ).

- DIAL takes wage claims only under $6,500 and within one year of when wages were due.
