How to file a wage claim in Oklahoma

  1. Gather your records

Dates and hours worked, your pay rate, pay stubs or bank deposits, texts or schedules, and the employer's name and address.

  2. Ask in writing first (optional)

A demand letter gives your employer a deadline to pay and shows you tried. Use the free letter on this page.

  3. File with Oklahoma Department of Labor

First ask your employer for the wages you are owed. Then file a wage claim with the Oklahoma Department of Labor, either with the online form (fastest) or with the paper Wage Claim Form returned in person or by mail to 409 NE 28th St., 3rd Floor, Oklahoma City, OK 73105. Use only one form, sign it, and attach time sheets and pay stubs if you have them. ODOL notifies your employer, who must answer in writing within 15 calendar days; a compliance officer investigates and can issue an order telling the employer to pay. There is no fee.

Minimum wage and overtime in Oklahoma

Oklahoma's minimum wage is $7.25 an hour, the same as the federal rate, and has been since July 24, 2000. The state law covers employers with at least 10 full-time employees (or equivalent) or more than $100,000 in yearly sales, unless federal law already covers them. Oklahoma has no higher city or county minimum wages listed by the state.

Overtime

Oklahoma has no state overtime law. If your employer is covered by the federal Fair Labor Standards Act, you must get 1.5 times your regular rate for hours over 40 in a workweek. There is no daily overtime. For overtime problems, the state sends you to the US Department of Labor.

Paydays: At least twice each calendar month on regular paydays set in advance (once a month for exempt and government employees). Payday can be no more than 11 days after the pay period ends, and the employer gets 3 more days to pay. You must get an itemized statement of deductions with each payment (Okla. Stat. tit. 40, § 165.2).

Penalties your employer may owe

If the employer willfully holds back final wages with no honest dispute, it owes liquidated damages of 2% of the unpaid wages for each day the failure continues, up to an amount equal to the unpaid wages (Okla. Stat. tit. 40, § 165.3(B)). In a court case for unpaid wages, the court may award costs and reasonable attorney fees (§ 165.9). For minimum-wage violations, the employer owes double the unpaid wages plus court costs and attorney fees of at least $100 (§ 197.9).

Retaliation and immigration status

Federal law also makes it illegal to fire or punish you for filing a wage complaint or cooperating in an investigation (US DOL Fact Sheet #77A).

The Oklahoma Department of Labor says every worker has the right to be paid fairly no matter their background or status, and you don't have to be a U.S. citizen to file a wage claim.

The US Department of Labor’s Wage and Hour Division enforces federal wage law without regard to immigration status, and its services are free and confidential whether you are documented or not (US DOL).

Deductions and tips

Besides taxes and court orders, deductions are allowed only for certain purposes (such as loans, uniforms, merchandise, insurance, or a cash shortage you alone caused) and only with a written agreement signed by both you and the employer, according to ODOL. Employers may count tips toward the minimum wage if they pay a cash wage of at least the federal tipped amount ($2.13) (Okla. Stat. tit. 40, § 197.16).

A short, firm letter asking your employer to pay what it owes by a deadline. Many workers get paid at this step, and in some states a written demand starts penalties or makes the employer pay your attorney fees later. Fill this in, then download the letter as PDF or Word (or copy it), sign it, keep a copy and send it in a way you can prove, such as certified mail or an email you keep.
